Pennsylvania trucking company allegedly required two logbooks

Federal prosecutors say a Pennsylvania trucking company encouraged its drivers to keep two sets of hours-of-service logs, and sent drivers on trips that required them to break federal on-duty requirements.

Lancaster, PA-based D.A. Landis Trucking Inc. faces felony charges of conspiracy and making false statements. In charges filed by U.S. Attorney Zane David Memeger of the Eastern District of Pennsylvania, Dean Landis, 45, the company’s owner, was also charged individually with conspiracy.

Prosecutors say that between 2007 and November 2009, D.A. Landis Trucking and Dean Landis helped company drivers maintain false hours-of-service logs and hid true work times from the U.S. Department of Transportation and the Federal Motor Carrier Safety Administration.

D.A. Landis Trucking drivers would mark trip sheets and hours-of-service documents as “Not 4 DOT,” “NO LOG” and “NO DOT” as code to tell management to put the items in a specific file cabinet. Those file cabinets were marked “NOT FOR DOT JANUARY,” and “NOT FOR SEPTEMBER 2009,” court documents show.

Court records show D.A. Landis employed 70 drivers, and made annual revenues of $6 million hauling milk from 700 individual dairy farms in Pennsylvania to large dairy processors in the region.

The company faces up to 5 years of probation and a $5.5 million fine. Dean Landis faces a maximum sentence of 5 years in prison and a $250,000 fine.
